Divorce for Nepali Citizens Living Abroad
If you are a Nepali citizen living abroad, you may still be able to file for divorce in Nepal without returning, depending on your circumstances. Through a legally executed Power of Attorney (PoA), an authorized representative can handle much of the legal process on your behalf. Both mutual consent divorce and contested divorce cases can be managed in accordance with the applicable laws of Nepal.
Approximate Processing Time
- Mutual Consent Divorce: Generally 1–4 weeks, depending on the court schedule and document readiness.
- Contested Divorce: May take 3 months to more than one year, depending on the complexity of the case, court hearings, and evidence required.
Required Documents
- Original or certified copy of the Marriage Registration Certificate (if available)
- Citizenship Certificate of both spouses (or copies)
- Valid Passport and Visa/Residence Permit of the spouse living abroad
- Power of Attorney (executed before the Nepali Embassy/Consulate or as permitted by law)
- Recent passport-size photographs
- Current overseas address and contact details
- Divorce petition and supporting affidavits
- Any supporting evidence relevant to the case (where applicable)
