TERMS AND CONDITIONS

INTRODUCTION

These Terms and Conditions ("Terms") govern your access to and use of the platform and IT services provided by Nepal Lawyer Services Pvt. Ltd. ("nepalLawyer.com," "we," or "us"), a legal services and management of lawyer’s connection platform registered under the laws of Nepal. By accessing or using our services, you agree to be bound by these Terms with full consent.

LEGAL STATUS AND COMPLIANCE

THIS PLATFORM IS NOT A MARKETING PLATFORM FOR LEGAL SERVICES AND OPERATES IN STRICT COMPLIANCE WITH THE NEPAL BAR COUNCIL ACT, 2050 (1993) AND RULES OF CODE OF CONDUCT OF LEGAL PRACTITONERS, 2079 (2023) RULE NO-4

This platform serves solely as a technological interface to facilitate connections between licensed legal practitioners and individuals seeking legal assistance, in accordance with rule-4 of the Our purpose is to RULES OF CODE OF CONDUCT OF LEGAL PRACTITONERS, 2079 (2023) enable access to justice through technology without engaging in advertising or marketing prohibited under Nepali law.

DEFINITIONS

"Platform" refers to the website, web pages, applications, designed and developed by Nepal Lawyer Service for use of lawyers and Clients in need.

"User" refers to any individual or entity accessing or using the Platform, including legal lawyers/ legal practitioners and clients.

"Legal Practitioner" refers to advocates, attorneys, and legal professionals duly registered with the Nepal Bar Council under the Nepal Bar Council Act, 2050 (1993).

"Client" refers to individuals or entities seeking legal services through the Platform.

ELIGIBILITY AND REGISTRATION

For Legal Practitioners:

  1. Only legal practitioners duly licensed and registered with the Nepal Bar Council under Chapter 4 Section 17 of the Nepal Bar Council Act, 2050 (1993) may register on the Platform.
  2. Legal practitioners must provide valid registration credentials and maintain good standing with the Nepal Bar Council throughout their use of the Platform.
  3. Legal practitioners must adhere to all provisions of the, RULES OF CODE OF CONDUCT OF LEGAL PRACTITONERS, 2079 (2023) including but not limited to restrictions on advertising and solicitation under rule 4.
  4. Legal practitioners acknowledge that their participation on this Platform does not constitute advertising or solicitation as prohibited by the Nepal Bar Council Rules, 2050 (1993).

For Clients:

  1. Clients must be at least 18 years old or have proper legal guardian consent to use the Platform, in accordance with the Nepal Civil Code, 2074 (2017).
  2. Clients must provide accurate and truthful information when registering and using the Platform.
  3. Clients acknowledge that their relationship with any legal practitioner is governed by the Contract Act, 2056 (2000) and applicable provisions of the Civil Code, 2074 (2017).
  4. Client’s consent taking is the duty of the legal practitioners not Nepal lawyers Service.

GENERAL TERMS & CONDITIONS

  1. NepalLawyer.com is in no way, directly or indirectly responsible for the advice and assistance provided by the Legal Practitioners. We are an independent third-party enabler who have built a platform where clients can communicate with, and if needed, meet Legal Practitioners. NepalLawyer.com has no control over the Services provided by the Legal Practitioner and will not be responsible for any issues/discrepancies with the Services provided.
  2. NepalLawyer.com has full rights to publish the free advice provided to clients on the portal and in any external communication for public knowledge sharing, in accordance with the Copyright Act, 2059 (2002). However, in none of the published content will the user details be displayed, in compliance with the The Privacy Act, 2075 (2018) Section- 11
  3. NepalLawyer.com has multiple Legal Practitioners for the same practice area, and there might be instances wherein a similar question has been answered in different ways. NepalLawyer.com takes no liability towards these different opinions and answers and encourages you to take another opinion from 'your' Legal Practitioner or decide which opinion to proceed with based on merits and logical conclusions.
  4. All materials and information on the Site are provided for informational purposes only and may not reflect current legal developments or variances in Nepali law. The materials and information do not necessarily reflect the opinions of the Legal Practitioners, their partners, clients, or affiliates. The information is not guaranteed to be correct, complete, or up to date.
  5. The mere receipt of an email from or a "post" on the Site does not create a Lawyer-client relationship as defined under the Legal Practitioners Act, 2050 (1993). The applicable Legal Practitioner is solely responsible for providing services to you, and you agree that NepalLawyer.com shall not be liable for any damages or costs arising out of or connected with your use of such services.

SERVICES

  1. The Platform facilitates connections between licensed legal practitioners and potential clients without engaging in advertising or marketing of legal services, in strict compliance with the Nepal Bar Council Rules, 2050 (1993).
  2. We do not guarantee the availability, quality, or outcome of legal services provided by legal practitioners through the Platform.
  3. Any fees charged by legal practitioners must comply with the Nepal Bar Council's and  RULES OF CODE OF CONDUCT OF LEGAL PRACTITONERS, 2079.
  4. All communications between legal practitioners and clients through the Platform shall remain confidential in accordance with RULES OF CODE OF CONDUCT OF LEGAL PRACTITONERS, 2079.

HOW DOES IT WORK?

If you choose to submit a Free Question on NepalLawyer.com, you will not be charged any fees; however, Free Questions may be delayed before processing. Any answers you receive from Legal Practitioners to Free Questions will not involve any Lawyer-client relationship and will be publicly displayed and viewable by all Users. You cannot choose the Legal Practitioner that will answer the Free Question – this is decided by the system automatically. The Legal Practitioner may choose NOT to answer your question with or without assigning a reason. You will be informed in such cases via email, SMS, and/or phone.

IMPORTANT: Though listing on NepalLawyer.com may increase the exposure and accessibility of a Legal Practitioner, we are not an advertising portal where professionals are listed on a priority driven by any fees paid. Our search and sort functionality are purely driven by user-entered information and the built-in algorithm, in compliance with RULES OF CODE OF CONDUCT OF LEGAL PRACTITONERS, 2079 (2023) RULE NO-4

 

WE DO NOT IN ANY WAY ENDORSE ANY INDIVIDUAL DESCRIBED HEREIN. IN NO EVENT SHALL WE BE LIABLE TO YOU OR ANYONE ELSE FOR ANY DECISION MADE OR ACTION TAKEN BY YOU IN RELIANCE ON SUCH INFORMATION.

INDEPENDENCE OF LEGAL PRACTITIONERS

The opinions, statements, and answers provided by Legal Practitioners via NepalLawyer.com are solely the individual and independent opinions of such professionals and do not reflect the opinions of NepalLawyer.com, its affiliates, or any organizations to which such Legal Practitioner is affiliated. NepalLawyer.com does not recommend or endorse any specific tests, Legal Practitioners, products, procedures, opinions, or other information mentioned on NepalLawyer.com.

You agree that you understand that the Legal Practitioners who participate in NepalLawyer.com are not employed by or agents of NepalLawyer.com. Although NepalLawyer.com requires Legal Practitioners to provide basic information about themselves (for example, information about jurisdictions in which they are licensed and areas in which they practice), NepalLawyer.com does not separately verify this information and makes no representations as to the qualifications of any Legal Practitioners.

Legal Practitioners do not provide any compensation or payment to NepalLawyer.com to become part of NepalLawyer.com or to answer questions, in strict compliance.

No representation is made that the quality of professional services to be performed is greater than the quality of professional services performed by other Legal Practitioners. We urge all potential clients to make their own independent investigation and evaluation of any Legal Practitioner being considered.

PROHIBITED ACTIVITIES

Users shall not:

  1. Use the Platform for marketing or advertising legal services in violation of Rule 4 RULES OF CODE OF CONDUCT OF LEGAL PRACTITONERS, 2079 (2023
  2. Engage in any activity that could bring the legal profession into disrepute per Rule-4,5 RULES OF CODE OF CONDUCT OF LEGAL PRACTITONERS, 2079 (2023
  3. Submit false or misleading information in violation of the Consumer Protection Act, 2075 (2018).
  4. Use the Platform for any unlawful purpose or in violation of any applicable laws of Nepal, including the Electronic Transaction Act, 2063 (2006).
  5. Attempt to interfere with system integrity or security, or bypass any measures of the Platform in violation of the Electronic Transaction Act, 2063 (2006).
  6. Engage in any conduct that restricts or inhibits any other user from using or enjoying the Platform.
  7. Reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Site or its Services without prior written consent.
  8. Misidentify yourself or impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.

WEBSITE USAGE TERMS

You represent and warrant that you are at least eighteen years of age and possess the legal right and ability to enter into agreements pertaining to these Terms of Use, to register on NepalLawyer.com under your own name, and to use NepalLawyer.com in accordance with these Terms of Use.

You are solely responsible for maintaining the confidentiality of your password and for all activities carried out under your NepalLawyer.com account, in accordance with the Electronic Transaction Act, 2063 (2006). You agree to prohibit anyone else from using your password and to immediately notify NepalLawyer.com of any unauthorized use of your password or other security concerns.

No party has the power or authority as agent, employee, or in any other capacity to represent, act for, bind, or otherwise create or assume any obligation on behalf of the other party for any purpose whatsoever.

USER'S PROFILE AT NEPALLAWYER.COM

Your NepalLawyer.com Profile is created to store records of your consultations and personal query/problem information online. Any information provided as part of a web, over-phone, or in-person/video consultation becomes part of your NepalLawyer.com Record. You agree to provide accurate information to help us serve you best and to periodically review and update such information as necessary.

NepalLawyer.com reserves the right to maintain, delete, or destroy all communications and materials posted or uploaded to the NepalLawyer.com Service according to its internal record retention and destruction policies, in compliance with the Electronic Transaction Act, 2063 (2006) and the Individual Privacy Act, 2075 (2018).

PRIVACY AND DATA PROTECTION

  1. We collect and process personal data in accordance with the Individual Privacy Act, 2075 (2018) of Nepal.
  2. Our Privacy Policy, incorporated by reference into these Terms, details our data collection, use, and protection practices.
  3. Users consent to the collection, storage, and processing of their personal information as described in our Privacy Policy.
  4. All data processing will comply with the requirements of the Information Technology Bill of Nepal, once enacted.

INTELLECTUAL PROPERTY

  1. All content on the Platform is protected by intellectual property rights governed by the Patent, Design and Trademark Act, 2022 (1965) and Copyright Act, 2059 (2002) of Nepal.
  2. Users retain ownership of content they submit but grant us a license to use, reproduce, and display such content for Platform operations.
  3. By submitting a Free Question to NepalLawyer.com, you understand and agree that your question and any answer provided by a Legal Practitioner will become part of the NepalLawyer.com public database and the sole property of NepalLawyer.com, in accordance with the Copyright Act, 2059 (2002).

PROTECTION OF PROPRIETARY INFORMATION

You agree that the Services, which include all software and information, both electronic and printed media, contain trade secrets and other proprietary intellectual property and are the proprietary property of NepalLawyer.com. They are protected by the Copyright Act, 2059 (2002), the Patent, Design and Trademark Act, 2022 (1965), and other proprietary rights and laws of Nepal.

You agree that you will not store, copy, modify, rent, lease, loan, sell, distribute, transfer, transmit, display, reverse-engineer, reverse-assemble, or otherwise attempt to discover any programming code or source code used in or with the Services. You will not otherwise attempt to transfer any right in the Services, create derivative works, or commercially exploit the Services in whole or in part.

LIMITATION OF LIABILITY

  1. TO THE MAXIMUM EXTENT PERMITTED BY THE CONTRACT ACT, 2056 (2000) AND CONSUMER PROTECTION ACT, 2075 (2018) OF NEPAL, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
  2. We do not guarantee the accuracy, completeness, or reliability of any information provided by legal practitioners through the Platform.
  3. Our liability shall be limited as prescribed under the Contract Act, 2056 (2000) of Nepal.
  4. In no event shall NepalLawyer.com be liable for any damages or costs arising out of or connected with your use of the services provided by Legal Practitioners.

DISPUTE RESOLUTION

  1. Any disputes arising from these Terms shall first be attempted to be resolved through amicable negotiations.
  2. If negotiations fail, disputes shall be resolved through mediation in accordance with the Mediation Act, 2068 (2011) of Nepal.
  3. If mediation fails, disputes shall be submitted to the exclusive jurisdiction of the courts in Kathmandu, Nepal, under the Administration of Justice Act, 2073 (2016) and Muluki Diwani Sanhita, 2074 (2017).

TERMINATION

  1. We reserve the right to suspend or terminate your access to the Platform for violation of these Terms or applicable laws.
  2. Legal practitioners who violate they may be reported to the Nepal Bar Council for disciplinary action under the Nepal Bar Council Act, 2050 (1993).

GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of Nepal, including but not limited to the Contract Act, 2056 (2000), Consumer Protection Act, 2075 (2018), Electronic Transaction Act, 2063 (2006), Individual Privacy Act, 2075 (2018), and other applicable laws and regulations of Nepal.

MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. Continued use of the Platform after such modifications constitutes acceptance of the updated Terms. Any revision or change will be binding and effective immediately on release of the revised Agreement or change to the Service(s) on our website.
