Alpana Bhandari received a Master of International Legal Studies from American University Washington College of Law. She is currently working on corporate matters involving Foreign Direct Investment (FDI), Foreign Trade Mark Registration, and corporate consulting. She practices corporate law and is a top female lawyer in Kathmandu Nepal, dealing with complex family law issues such as contested divorce, alimony, child support, property, and court marriage.

As of May 29, 2019 the Ministry of Industry, Commerce and Supplies of Government Of Nepal published a notice in respect to minimum amount requirement for the foreign investors and Investment Company being held under the classification of industry as presented in Gazette.
The foreign investors are required to invest the minimum Nepali Rupees 5 crore (50 Million) per investor.
Under the Industrial Enterprise Act 1992 (2049) the Investment Company was listed as industry BUT the newly developed new Industrial Enterprise Act 2016 (2073) missed to incorporate to Investment Company under the industry category to which government of Nepal has amended the Schedule 8 of Industrial Enterprise Act 2016 (2073) and listed Investment Company under the industry category. The revision has allowed foreign investors to set up an Investment Company in Nepal.
A trademark, also known as brand name constitutes a label, signature word, symbol, name or numerals or colors pattern used to differentiate one merchandise or services to similar kinds deriving from different undertakings Patent, Design and Trademark Act, 1965 (2022) (“PDTA”) governs registration of local trademark in Nepal.
- The chosen mark MUST be represented in graphics.
- It MUST be distinctive to the goods and services from somebody else’s undertakings.
- It MUST be used as a mark in respect to the goods or services so as to indicate link at the time of trade between the goods or services and he/she is entitled to use the mark with or without disclosing his/her identity.
Registering a trademark before the competent authority of Nepal provides for legal legal protection. Person that desires to register the trademark MUST submit the registration application in line with Section 17 of PDTA.
Department of Industry (“DOI”) under the Ministry of Industry, Commerce and Supplies of Government of Nepal (web-link: http://www.doind.gov.np/) registers and administers trademarks in Nepal
Once you've decided that your preferred brand name or logo isn't registered in Nepal's Trademark Registry, Then, in line with Clause 17 of the Patent, Design, and Trademark Act of 2022 (1965), an application must be filed. Anybody who intends to register a trademark for his or her commercial business under the act must submit a request to the Department in the specified manner.
Under Section 18.1 of PDTA, the Department of Industry (DOI) has authority to reject the application of trademark registration on the specified grounds below:
- 1. In case such trademark inflicts harm on the reputation of any institution, person or
- 2. In case such trademark is inconsistent with public conduct/morale or national interest, or
- 3. In case such trademark causes harm on goodwill of trademark of any person, or
- 4. In case such trade-mark is already taken.
12 to 14 months to complete the licensure process without opposition petition made.
7 years from the date of registration. However, trademark can be renewed for any number of times for a period of 7 years at a time.
